【FULL】Mastering the keys to handling payment disputes under the SOPO framework

Mr. Wong will explain from the perspective of the employer, main contractor and sub-contractor respectively what they should do when handling payment disputes under the SOPO framework. He will take the audience through the SOPO Adjudication Rules of HKIAC (one of the adjudicator nominating bodies), including its template Notice of Adjudication. He will also look into what should be covered in different adjudication papers (adjudication submissions, response and reply), bad practices that should be avoided, and what ought to be enclosed as supporting documents. In this connection, he will discuss common issues that may give rise to grounds to challenge an adjudication determination and how they may be avoided from the outset.

 

Last but not least, Mr. Wong will also explain what needs to be done to better prepare for the actual logistics of handling payment disputes, including documentation and whether external consultants need to be engaged to handle payment disputes and/or SOPO adjudication proceedings.

Mr. WONG, admitted as a solicitor in 2013, is a Senior Associate of the Construction Department of Deacons. He specialises in dispute resolution with a particular emphasis on construction. He has wide experience in handling different types of claims brought by contractors and consultants arising from private and public construction projects. He advises on non-contentious construction related matters from time to time such as tender documents, works contracts, term contracts, consultancy agreements, fitting-out contracts, performance bonds, etc. In particular, he has extensive experience in revamping construction contracts for and/or providing training workshops to developers, private enterprises, statutory bodies and professional bodies for the Construction Industry Security of Payment Ordinance (Cap. 652) (“SOPO”).
