Managing Contract and Payment Disputes under Security of Payment Ordinance

The Construction Industry Security of Payment Ordinance (the “Ordinance”) has been gazetted on 27 December 2024 and will come into operation on 28 August 2025. Construction contracts entered into on or after that date will be governed by the Ordinance. The power of the Secretary for Development for registration and administration of Adjudicator Nominating Bodies (ANBs) will take effect on the gazettal date.

The Ordinance aims to improve contractual payment practices, and it is crucial for industry players to understand contract and payment management under its provisions. In this sharing, Sr Eric TING will discuss measures to address the Ordinance’s requirements and some suggested practices for managing contract and payment disputes.

Sr Eric TING is currently the Vice-Chairman of HKIS QSD Council 2024-2025 and the Chairman of the QSD Contract Sub-committee.

 

Sr Eric TING has solid experience in construction claims, contract advice and quantity surveying services in both private and public projects. His professional experience covers various types of projects such as civil engineering works, building works, mechanical and electrical works, maintenance works etc..

He is a visiting lecturer, trainer and speaker in courses and seminars on quantity surveying, NEC, collaborative contracting and dispute resolution.

 

As a claim and dispute resolution consultant, Sr Eric TING offers his specialised skills and disputes management experience to the clients from diverse backgrounds. He serves as an adjudicator on the HKIS Panel of Adjudicators, and HKIS has been admitted by the Development Bureau as one of the Adjudicators Nominating Body (ANB) under its Register of ANBs. Additionally, he serves as a quantum expert for cases in arbitration tribunals and the courts.
