Mutual trust and co-operation and Assessment of Compensation Events in the NEC: how do we give practical effect to these obligations?

This seminar will explore the principles of good faith and the duty to “act in a spirit of mutual trust and co-operation” under the NEC, and how these obligations are construed by the courts and how they can be put into practice.

The speakers will address practical examples of how mutual trust and co-operation can be applied and can practically assist in resolving the parties’ different obligations under the NEC. They will also talk about some of the challenges arising out of the mechanism regarding the assessment of compensation events under the NEC where mutual trust and co-operation has a significant role to play in the process of assessing and resolving compensation events.

Mohammed Talib – Mohammed is a Partner with Pinsent Masons and is a Solicitor Advocate who specialises in construction law, competition law in the infrastructure sector and international arbitration. He has been involved in a wide range of construction disputes, and his practice focuses on the contentious aspects of projects, acting for employers, main contractors and sub-contractors in arbitration and litigation on building and civil engineering projects.

 

Stephanie CHING – Stephanie is an Associate with Pinsent Masons, with a focus on contentious legal work in litigation and arbitration on construction projects in Hong Kong and overseas. She has assisted in various high value local and international arbitrations and in advising clients on contractual and commercial issues.
