香港經濟日報 – 營造師註冊制 挑戰與機遇

現今整體環球經濟嚴峻的形勢下,建築業的市場競爭不只日趨激烈,更要面對成本高昂、人手短缺、生產力下降等問題。香港要在國際市場立於不敗之地,就必須加強建築工程管理,推動人力的培訓發展,而落實營造師註冊制度就是重要的一步,方能配合業界的變革。

建築工程牽涉多個專業工種,每個環節的小問題均可能影響工程的質量及施工進度,甚至造成無法估計的損失。因此,建築項目負責人必須為「通才」,具備多方面的專業,包括相關建築技術、法律知識、工程規定、預算管理等範疇,而營造師正為肩負這個重任。

建築業的專業性不斷提高,加上近年業界在設計、結構和建造,以至建築施工、監管和分析都趨向智慧型發展,需要更多新血加入,至於如何吸引青年人投身其中,並留在業界累積經驗成為專業的註冊營造師,正是一大挑戰。

事實上,要成為學會的註冊營造師殊不簡單,在專業經驗、資格及學歷方面均有相當要求,如(a)學會之法定會員不少於兩年;及(b)在申請註冊的日期前已在香港有兩年相關的專業經驗;及(c)必須為認可人士或註冊結構工程師;或(ii)註冊建築師、註冊專業工程師(建築、屋宇設備、土木工程、岩土或結構)或註冊專業測量師(建築或工料測量);或(iii)是註冊一般建築承建商的授權簽署人;或(iv)已獲得認可的建造管理碩士學位或管理局認可的相等學歷;或(v)已完成由學會安排的一個指定註冊營造師銜接課程並成功通過評核;以及其他條件等。

另外,近年政府亦投放不少資源,如透過建造業學院提供相關培訓課程,培育出色及不同的專業人士及工程管理人員,建造商會、建築學會及建造學院亦有課程提供相關專工認證,學員們可從中累積更多知識、經驗及專業資歷,從而增加晉升機會,驅使他們留在行內發光發熱。與時同時,承建商亦不斷尋求進步,引入創新科技以提升專業形象、安全表現,以及改善工地環境等。

學會及業界正致力透過各項措施克服挑戰,吸引更多人才成為營造師,並期望政府早日落實營造師註冊制度,抓緊建築業的發展機遇,提升香港的競爭力。

Mr Joseph Chung

Joseph Chung is a Solicitor Advocate. He is also a registered foreign lawyer of the
Singapore International Commercial Court. He was previously a Barrister until he became a Solicitor in 2001. He is also a fellow member of the Chartered Institution of Civil Engineering Surveyors.

Joseph has extensive experience in all aspects of construction in both private and public sector work, advising developers, contractors, consultants and banks.

Over the years in his practice as a lawyer, he has been involved in many high profile construction projects, including the Hong Kong airport core project, the Express Rail Link and the Hong Kong-Macau-Zhuhui Bridge. He was involved in the Commission of Inquiry into Excess Lead found in Drinking Water in 2015/2016. He is recommended in the area of construction in the Asia Pacific Legal 500 (2014 – 2021 editions) and acknowledged as one of the leading lawyers in the area of construction in Chambers Asia Pacific (2014 – 2021 editions) and the exclusive winner of the “Construction” category in Hong Kong by the Client Choice Awards 2018 & 2021. He is also recognised as a Leading Construction & Infrastructure Litigation Lawyer (2020 – 2021) and a Leading Front End Construction, Infrastructure & Projects Lawyer (2020) by Doyle’s Guide Hong Kong.

Joseph is the co-author of the Hong Kong version of one of the leading UK construction text “Emden’s Construction Law in Hong Kong”.
