Online CPD Seminar on “Strategies to keep arbitration proceedings cost-effective" was successfully held on 14 September 2020.

Ms. Helen Au shared with us the strategies which could be adopted for the purpose of keeping an arbitration cost-effective, encouraging parties to take a fresh perspective at the outset of arbitration, and to put in a new dynamic throughout the arbitration proceedings.

Highlights:

Rules of arbitration generally do not contain any detailed provisions concerning document production. They generally do not specify how hearings should be conducted, and how witnesses, if any, should be heard.

This characteristic of arbitration entails that detailed and specific procedures can be custom-made for different disputes. It is therefore possible, and desirable, to shape the arbitral proceedings with appropriate procedural directions at an early stage, so that the duration and cost of the arbitration are commensurate with what is at stake in the case in light of the claims and issues put before the tribunal.

There are also strategies which can be adopted to keep arbitration proceedings duration and cost effective. This talk is intended to, for the purpose of keeping an arbitration cost-effective, encourage parties to take a fresh perspective at the outset of arbitration, and to put in a new dynamic throughout the arbitration proceedings.

 

About the Speaker: 

Ms Helen Au
Helen is a practicing barrister in Hong Kong, specialising in commercial litigation and arbitration. She also serves public appointments, including sitting as a Member of the Board of Review (Inland Revenue Ordinance), and as a Chairperson of the Appeal Tribunal Panel (Buildings).

Helen is a fellow of the Chartered Institute of Arbitrators. She serves as a Visiting Lecturer at the Polytechnic University of Hong Kong, teaching “Arbitration Law and Practice” to postgraduate students of the “MSc in Construction Law and Dispute Resolution” programme.

In addition to representing clients as a party representative in arbitration proceedings, Helen also sits as an arbitrator.
