Making Sense and Making Use of the Contractual Framework
and Process for Resolving Construction Claims and Disputes
– A Legal Clinic

Speaker: Ms. Rachel Chan is a partner of the Dispute Resolution Practice of Kwok, Yih & Chan, and is qualified in Hong Kong and England and Wales. She has over 15 years of experience and has acted on commercial and infrastructure disputes of varying scales and complexities in Hong Kong and other jurisdictions, including Mainland China, Macau, Dubai, the Philippines and the Latin America. She has represented a wide spectrum of clients including employers, private and commercial developers, public authorities, contractors, subcontractors, specialist suppliers and consultants in arbitration matters as well as in Court and other proceedings.

Ms. Rachel Chan looked into some common difficulties and discussed how a construction manager and his team may use and rationalize the dispute resolution process to minimize the risks and frustrations for all that are involved.  She has also talked about practical tips and measures which could be adopted during the contract stage prior to the formal disputes arising that could save time and money, and ultimately enhance the prospects of a successful claim or defence, or a timely settlement, followed by a Q&A session.

Cr Betty Lo, HKICM CPD Committee Chairperson presented a souvenir as a token of appreciation to Ms. Rachel Chan.

Highlights:

Managing construction claims and disputes is often a frustrating exercise.  It is time-consuming and costly, and the outcome is not always the best one would hope for.  You soon find out you cannot really sub-contract or delegate everything to your lawyers or experts, as they keep coming back to you with more questions or requests.  In this CPD, Rachel will look into some common difficulties and discuss how a construction manager and his team may use and rationalize the dispute resolution process to minimize the risks and frustrations for all that are involved.  In particular, Rachel will talk about practical tips and measures which could be adopted during the contract stage prior to the formal disputes arising that could save time and money, and ultimately enhance the prospects of a successful claim or defence, or a timely settlement.
